Terms of sale

ARTICLE 1, PURPOSE AND SCOPE
These terms of sale govern all sales of products made on hyggomi.com by Jason Espinasse, sole trader (the "Seller"). Placing an order implies full acceptance of these terms by the customer (the "Customer"). They apply to consumers. Nothing in these terms affects the statutory rights that the law of the Customer's country of residence grants and that cannot be waived by contract.

ARTICLE 2, PRODUCTS
Products are described and presented as accurately as possible. Photographs and visuals are not contractual and may differ slightly from the actual product. Products are offered while stocks last.

ARTICLE 3, PRICES
Prices for the United Kingdom are shown in pounds sterling and include VAT where applicable. Delivery costs, if any, are shown before the order is confirmed. The Seller may change prices at any time; products are invoiced at the price in force when the order is confirmed.

ARTICLE 4, ORDERS
The Customer selects the products, checks the order details, then confirms the order after accepting these terms. The sale is final once the order is confirmed by email and payment is received. The Seller reserves the right to cancel any order in the event of a payment dispute, suspected fraud or an obvious pricing error.

ARTICLE 5, PAYMENT
Payment is made online by card or by the other methods offered at checkout, through secure payment providers. Payment details are never stored by the Seller. The order is processed once payment is confirmed.

ARTICLE 6, DISPATCH AND DELIVERY
Details and times are set out in our Shipping Policy. Orders are delivered within 10 working days of being confirmed, processing and transit included. Some products are dispatched from our partner warehouses located outside the United Kingdom. The Seller takes care of all applicable import formalities and costs: no customs charges, import taxes or handling fees will be asked of the Customer on delivery. Delivery times are given as a guide; a delay cannot give rise to cancellation or damages, except where the law provides otherwise.

ARTICLE 7, CANCELLATION AND MONEY-BACK PROMISE
Under applicable consumer law, the Customer has 14 days from receiving the product to cancel the order, without giving a reason.
In addition to this legal right, the Seller grants a money-back promise extended to 30 days from receipt of the product. This commercial promise is in addition to the legal cancellation right and statutory guarantees, never in place of them.
The Customer may handle and try the product as needed to establish its nature, characteristics and proper working; the Customer is only liable for any loss in value resulting from handling beyond that.
Return postage is paid by the Customer. Refunds are issued within 14 days at most of receiving the returned product or proof of postage. Full details are set out in our Refund Policy.

ARTICLE 8, STATUTORY GUARANTEES
Independently of any commercial promise, the Customer benefits from the statutory guarantees applicable to consumer goods, including that products must be as described, fit for purpose and of satisfactory quality.
The Seller is liable for conformity defects existing at delivery that become apparent within two years of delivery. In case of a conformity defect, the Customer may choose between repair and replacement, carried out at no cost to the Customer, including return postage. If the product is replaced, a new two-year guarantee runs from the date of replacement.
These guarantees do not cover normal wear (such as the gradual reduction of battery life with charge cycles), nor damage resulting from a fall, impact, immersion, lack of care, use contrary to the instructions, or repair or modification carried out by the Customer or a third party.
To make a claim, the Customer writes to contact@hyggomi.com or texts +33 7 56 86 58 10, quoting the order number and describing the issue. A reply is given within 24 working hours, with the practical return instructions. Where the product can be returned by post without major inconvenience, it is sent back by post at the Seller's expense.

ARTICLE 9, LIABILITY
The Seller cannot be held liable for damage resulting from misuse of the product, nor for damage linked to an interruption or malfunction of the internet network.

ARTICLE 10, FORCE MAJEURE
The Seller cannot be held liable for non-performance due to an event of force majeure.

ARTICLE 11, PERSONAL DATA
The processing of the Customer's personal data is described in the Privacy Policy.

ARTICLE 12, COMPLAINTS
Any complaint may be sent by email to contact@hyggomi.com, or by text to +33 7 56 86 58 10 (this number receives text messages only, it does not take calls). The Seller undertakes to reply within 24 working hours.

ARTICLE 13, CONSUMER MEDIATION
After first attempting to resolve a dispute directly with the Seller by written complaint to contact@hyggomi.com, the Customer may refer the dispute free of charge to the consumer mediator the Seller is registered with:
CM2C, Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, France, www.cm2c.net, contact@cm2c.net.
The referral must be made within one year of the written complaint to the Seller.

ARTICLE 14, GOVERNING LAW AND DISPUTES
These terms are governed by French law, without depriving the Customer of the protection of the mandatory consumer provisions of the law of their country of habitual residence. Failing amicable resolution, disputes are brought before the competent courts.
